In Pennsylvania, when you are charged with drunk driving and are under the legal drinking age, you can face a mandatory suspension of your license for up to a year, as well as up to $5,000 in fines. In addition, you will be held to a much stricter standard than an adult in the same situation — you will be considered legally intoxicated if your blood alcohol content is .02 or higher (compared to .08 for noncommercial drivers over the age of 21).
When you hire us to represent your underage child in a DUI prosecution, we will carefully investigate the facts and circumstances of the arrest, looking first to determine whether police had probable cause to make the traffic stop. We will also verify that field sobriety and blood alcohol tests were properly administered, and that your son or daughter was properly notified of his or her rights if taken into custody.
If your child was under the age of 18, all proceedings will fall under the jurisdiction of the juvenile courts, with potential punishment including probation, the payment of a fine or placement in a treatment facility. If, however, your child was between the ages of 18 and 21, he or she will be subject to substantially greater sanctions, including mandatory attendance at an alcohol highway safety school and potential community service.
When appropriate, we will work closely with juvenile justice officers and prosecutors to minimize the consequences of an arrest, looking to reduce or dismiss charges in exchange for participation in a diversionary program, such as substance abuse counseling.
